1. SCOPE OF APPLICATION. WHAT DOES THIS PRIVACY POLICY COVER?
1.1. This Privacy Policy is applicable to the personal data (hereinafter, "Personal Data", "Data" or "Information", indistinctly) that you provide to RAFAC SRL (hereinafter Nectica), CUIT 30-71576170-6, with legal domicile in O'Higgins 2587, Ciudad Autónoma de Buenos Aires through its websites.
1.2. Likewise, this Privacy Policy is applicable to the Personal Data you provide through telephone communication channels, customer service e-mails and chats offered by Nectica, applications for electronic devices and accounts that Néctica's Business Units have in social networks, such as Facebook, Instagram, Twitter, LinkedIn and others (hereinafter, "Communication Channel/s"). PRIOR TO BROWSING AND/OR REGISTERING AS A USER ON ANY OF THE WEBSITES AND/OR CONTACTING NECTICA THROUGH ANY OF THE COMMUNICATION CHANNELS, YOU MUST READ AND ACCEPT THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU SHOULD REFRAIN FROM BROWSING, REGISTERING AND/OR USING IN ANY WAY, ANY WEBSITE AND/OR ANY OTHER CHANNELS OF COMMUNICATION WITH Nectica.

2. DATABASE REGISTRATION. WHAT DATA DO WE COLLECT?
2.1. Nectica may request contact data, such as landline phone, cell phone, address, zip code, email, social network user.
2.2. Nectica may request additional Personal Data, which will be informed in each case and whose processing will also be carried out in accordance with this Privacy Policy.
2.3. In all cases, You may refuse to provide the Personal Data requested.
2.4. The Personal Data provided by You through the Websites will be included in a customer database, owned by Nectica, duly registered with the Agency for Access to Public Information.

3. PURPOSE OF THE PROCESSING OF PERSONAL DATA. WHY DO WE USE YOUR DATA?
3.1. Nectica will process your Personal Data in accordance with the provisions of Law No. 25.326, on Personal Data Protection, its Regulatory Decree No. 1558/2001 and other complementary rules, or those that may amend or replace them in the future. Likewise, it shall adopt the necessary technical and organizational measures for the custody, storage, preservation and confidentiality of the Information in order to avoid its alteration, loss, treatment or unauthorized access.
3.2. The Personal Data You provide to Us will be used for the following purposes: i) To comply with Nectica's legal and contractual obligations in case You have chosen to purchase goods or contract services through a Website or a Communication Channel, including - but not limited to: (a) verifying your identity to interact as a user on our Website, (b) verifying your identity to make a purchase on the Website or manage a claim, (c) telling you which branch of the Business Unit in question is closest to your home and estimating shipping costs and delivery times, (d) correctly issuing vouchers for transactions made on the Website, (e) recording the delivery of products purchased, (f) reminding you of products previously purchased by you to facilitate your shopping experience and determine your consumer profile. ii) Elaborate statistics, market research and consumption profiles based on your contracts and interactions on the Websites and on the accounts that Nectica's Business Units have on social networks. iii) Include you in sweepstakes and/or promotions in which Nectica is involved as organizer or sponsor. iv) Send you advertising, newsletters, institutional news, satisfaction surveys, offers and promotions and any communication for marketing and advertising purposes, by any means of contact that you have provided (e-mail, cell phone, landline, social network user, postal mail), from any of Nectica's Business Units. v) Provide Customer Service. vi) Manage claims, complaints and suggestions. vii) Manage procedures related to the Loyalty Programs and their registration on the Websites.
3.3. In any case, you may revoke your consent for Nectica to process your Personal Data, with respect to any or all of the Business Units, unless such data is necessary for Nectica to comply with a legal or contractual obligation previously assumed, in which case it will proceed to the deletion of your Data immediately after the obligation in question has been fulfilled. In no case, the revocation of consent shall have retroactive effects.

4. TERM OF CONSERVATION OF YOUR PERSONAL DATA
Nectica will keep your Personal Data for the time necessary to fulfill the purposes described in this Privacy Policy and/or legal and contractual obligations. Your Information will be destroyed when it is no longer necessary or relevant to the purposes for which it was collected, unless there is a legal obligation to keep it for a longer term.

5. YOUR RIGHTS AS OWNER OF YOUR PERSONAL DATA

Right of Access: You have the right to exercise the right of access to your Personal Data free of charge at intervals of no less than six (6) months, unless a legitimate interest to that effect is evidenced, pursuant to the provisions of article 14, paragraph 3 of Law 25.326, by sending an e-mail to info@nectica.com.ar or by calling 54 11 5236-1175.
5.2. Rights of rectification, suppression and updating: Likewise, you have the right to request the rectification, suppression or updating of your Personal Data, at any time, by sending an e-mail to info@nectica.com or by calling + 1 (786) 209-1668.
5.3. To exercise any of the rights mentioned in points 4.1. and 4.2. above, Nectica may request a copy of your ID in order to verify your identity, which will be destroyed immediately upon completion.
5.4. If you do not wish to receive communications for advertising and marketing purposes in general, you may request at any time the withdrawal or total or partial blocking of your Data for such purpose by sending an e-mail to info@nectica.com or by calling: + 1 (786) 209-1668. This option will also be informed in the advertising and marketing communications sent. The withdrawal or blocking of your Data from the Database for advertising purposes shall not prevent Nectica from sending you the necessary communications to comply with its contractual and legal obligations previously assumed.

6. USE OF COOKIES
6.1. The Websites use an identification technology based on "cookies", which is necessary to use the services and content provided by the Websites. 7.2. If you do not agree with the modifications introduced, you must refrain from accepting the new Privacy Policy.

8. APPLICABLE LAW AND JURISDICTION
8.1. This Privacy Policy is governed by Law No. 25.326, on Personal Data Protection, its Regulatory Decree No. 1558/2001 and other complementary rules. In case of dispute, Nectica and the holder of the Personal Data shall submit to the competent courts.
8.2. The Agency of Access to Public Information, the controlling body of Law No. 25.326, is responsible for dealing with complaints and claims filed in relation to the non-compliance with the rules on Personal Data protection.
